Draft — under legal review. The final version may change before launch.
These terms take effect when the service launches. Until then, nothing here applies to you.
More ways to care for your cat or dog are on the way 🐾 This page holds the rules for each Swipaw service still marked "coming soon", and none of it applies until that service opens.
In short: Each section switches on only when its service goes live, and you accept it at first use. Providers, shelters, foundations and organisers run their own services; we check them, run Payment Protection (protektado ang bayad mo) and handle complaints. Vets must be PRC-licensed, pet taxis franchised and trainers humane. Adoption is never a sale, donations go only to permitted organisations, and lost-pet rewards stay between owner and finder. The numbered clauses govern.
1. How these terms work#
- Who we are. Swipaw is operated by Parada Technologies Inc. ("Swipaw", "we"). These Additional Services Terms ("these terms") form part of our Terms of Service (the "Terms") and cover each service still "coming soon" in the app (each a "Service").
- Start date. Each section takes effect only when its Service goes live in the app. We may also publish a section on its own, marked "effective on launch".
- Other documents. The Community Guidelines, Payments & Refunds Policy, Verification Policy and, for paid services, the Provider Agreement also apply; each section prevails over them for its own Service. The Privacy Notice covers personal data.
- Acceptance. You accept a section the first time you list, book, apply, donate, RSVP, post or buy in its Service; we record the version, time and platform, and acceptance binds like a signature (Electronic Commerce Act, RA 8792). Changes follow clause 1.5 of the Terms and never alter what is already confirmed.
- Who you deal with. Providers, shelters, foundations and organisers act for themselves, not as our employees or agents, and contract with you directly; Swipaw is a party only where a section says so.
- Payment Protection. Xendit Philippines, Inc. ("Xendit"), our payment partner registered with the Bangko Sentral ng Pilipinas, processes payments. Under Payment Protection, Xendit collects a booking, ticket or adoption fee into an account it keeps for the payee and holds it there until the service is done; at release our disclosed commission, if any, is split off and the rest paid out. Swipaw never holds that money in trust, on deposit or in its own name. Bookings are released when you confirm or, unless you dispute first, 48 hours after the provider marks them done (or the period shown). Donations and shop orders follow sections 7 and 12.
- Cancellations. For bookings, unless the listing showed another policy before you paid, your Service's row applies, counted back from the booked start:
| Service | Free cancellation | Partial refund | Late cancellation |
|---|---|---|---|
| Stud services | Up to 48 h before the start: 100% back | 48 h to 12 h before: 50% back | Less than 12 h before: 0% back |
| Paid playdates | Up to 24 h before the start: 100% back | 24 h to 6 h before: 50% back | Less than 6 h before: 0% back |
| Pet hotel & boarding | Up to 48 h before the start: 100% back | 48 h to 24 h before: 50% back | Less than 24 h before: 0% back |
| Grooming | Up to 24 h before the start: 100% back | 24 h to 6 h before: 50% back | Less than 6 h before: 0% back |
| Vet visits | Up to 12 h before the start: 100% back | 12 h to 3 h before: 50% back | Less than 3 h before: 0% back |
| Sitting & walking | Up to 24 h before the start: 100% back | 24 h to 6 h before: 50% back | Less than 6 h before: 0% back |
- Your remedies. These windows cover a change of mind only. Provider cancellations are refunded in full, as are bookings cancelled under a force-majeure notice we post (such as a typhoon signal or government order). For a defective, incomplete or undelivered service you may still ask, through a dispute, for re-performance, a refund or a lower price (Consumer Act, RA 7394, Art. 102). We decide complaints within 7 calendar days (Internet Transactions Act, RA 11967, sec. 24); see our Complaints page.
2. Vets and teleconsults#
Effective when this service launches.
- Licensed vets only. Only veterinarians with a current Professional Regulation Commission (PRC) licence may offer veterinary services (Veterinary Medicine Act, RA 9268). Vet listings also need a Mayor's permit, and clinics a Bureau of Animal Industry (BAI) registration (Animal Welfare Act, RA 8485, as amended by RA 10631). We verify the licence before a listing goes live and show its number.
- Your vet, not Swipaw. A consultation at a clinic, at home or by teleconsult is between you and the vet, who alone decides on diagnosis, treatment and prescriptions and answers professionally for them. Swipaw gives no veterinary advice: Breed & Health Library articles are general information, and referral-board posts are members' opinions under our Review Policy.
- Teleconsults. A teleconsult, a consultation through the booking chat, is the practice of veterinary medicine, given personally by the listed vet, who may instead ask to see your pet. Dangerous drugs are never prescribed through the chat (Comprehensive Dangerous Drugs Act, RA 9165), and only verified vet accounts may send prescriptions there.
- Emergencies. Bookings and teleconsults are not emergency care; if your pet's life is at risk, go to the nearest open clinic now.
- Records. The vet or clinic keeps your pet's medical record and answers for it under the Data Privacy Act (RA 10173); ask them for copies.
- Prices and tax. Each listing says whether the provider is a clinic or an individual vet, and prices include tax: a clinic's veterinary services are VAT-exempt (National Internal Revenue Code, RA 8424, sec. 109(1)(G)), while an individual vet's fees may carry VAT or percentage tax. Every fee paid through Swipaw is in your quote; anything else is bought directly from the clinic. The vet row of clause 1.7 applies.
3. Sitting, walking and daycare#
Effective when this service launches.
- Care standard. Sitters, walkers and daycare hosts (each a "sitter") are independent providers who care for your pet with the diligence of a good father of a family (Civil Code, RA 386, Art. 1173), or any higher standard they promise, follow your instructions and never leave your pet tied up or alone longer than agreed.
- Your part. Before the first visit, give written care instructions in the booking chat (feeding, medicines, your vet, an emergency contact) and disclose any illness, heat, pregnancy, aggression, escape habits or bite history. A sitter may decline to start over a serious undisclosed problem, with a full refund to you and no penalty for the sitter.
- Medicines. Sitters give only medicines your vet prescribed, exactly as labelled, log each dose in the booking chat, and never diagnose or treat (Veterinary Medicine Act).
- Keys and home access. Share keys or codes only after the booking is confirmed; the sitter uses them only for booked visits, never copies or lends them, brings no guests and returns them at the end. Tell the sitter about any home cameras.
- Walks. Dogs stay on a leash of 1.5 metres or less in public, are muzzled if they have a bite history (Anti-Rabies Act, RA 9482) and run free only in an enclosed area you approved.
- Incidents. The sitter tells you at once, and files the booking's incident report within 2 hours, of any injury, illness, escape, death or damage, and reports a bite to the barangay or city veterinary office within 24 hours. If your pet needs urgent care and neither you nor your emergency contact answers, the sitter takes it to your vet or the nearest open clinic and may approve care up to the booking's emergency amount (by default ₱5,000), payable by you unless the sitter was negligent.
- Who answers for what. Between you, the sitter answers for loss from their negligence and you for harm from your pet's undisclosed health or behaviour. Towards others, either of you may answer as the animal's possessor or user (Civil Code, Art. 2183), and a dog's owner pays a bite victim's medical costs (Anti-Rabies Act, sec. 5(f)).
- Home boarding. A sitter keeping more than one client pet at home first declares a BAI registration and Mayor's permit, or the BAI's written confirmation that none is needed (Animal Welfare Act, sec. 2).
4. Pet taxi#
Effective when this service launches.
- Franchised operators only. Carrying pets for a fee is a public service: only operators holding a certificate of public convenience or TNVS authority from the Land Transportation Franchising and Regulatory Board (LTFRB), with vehicles registered for hire and professionally licensed drivers, may list (Public Service Act, CA 146; Land Transportation and Traffic Code, RA 4136). Motorcycles are not allowed. We check these papers before a listing goes live; plate numbers stay private.
- The carrier's duty. The operator and driver are a common carrier: they owe extraordinary diligence over your pet and any passenger and are presumed at fault for loss, injury or death in transit unless they prove a cause the Civil Code allows (Arts. 1733–1735, 1755–1756). Nothing in a listing, a notice or these terms lessens that duty (Arts. 1744–1745, 1757). Swipaw is not a carrier.
- Humane transport. Cats ride in closed carriers and dogs in a crate or secured harness, never in a trunk, under a hood, on a roof or in an open bed without a secured cage. Vehicles are ventilated or air-conditioned, water is offered on trips over 2 hours, and no trip exceeds 12 hours (Animal Welfare Act, sec. 4; BAI Administrative Order No. 19, s. 2006).
- Fit to travel. Dogs and cats 3 months or older need a current anti-rabies vaccination certificate (DA Administrative Order No. 10, s. 2005). Sick or injured animals, heavily pregnant females and pets under 8 weeks ride only to or from a vet.
- No other passengers. The driver takes no other passengers or bookings on your trip. You ride along only if the listing allows it and the franchise covers passengers, as the booking states.
- Area. At launch, trips start and end in Metro Manila. Inter-province trips, once offered, need the owner's BAI shipping permit and a vet health certificate issued within 3 days of travel.
- Fares and waiting. We compute the fare from your route and the listing's rates and show it before you pay. Waiting is charged only at a per-minute rate on the listing, only for delays you cause and only through the app, never in cash. The pet taxi row of clause 1.7 applies.
- Regulatory note. Pet Taxi launches only once its franchise arrangements are confirmed with the LTFRB; any other set-up, such as an escort riding in a franchised vehicle, needs an updated section first.
5. Training#
Effective when this service launches.
- Humane methods only. No shock, prong or pinch collars, hanging or lifting by the collar, hitting, kicking or withholding of food, water, rest or shelter: these can be cruelty under the Animal Welfare Act (sec. 6). Muzzles are for safety only, properly fitted and worn briefly.
- A programme, not a guarantee. Each programme states in writing its goals, the number and length of sessions, its methods and place, and the practice expected of you. Results depend on your pet and your follow-through, so no trainer may promise guaranteed results.
- Credentials. "Certified by" and a certifying body appear only after we verify the certificate, and no trainer may claim credentials or endorsements they cannot show (Consumer Act, Art. 50).
- Health first. Disclose aggression and bite history. Trainers refer possible medical causes to a vet and give no veterinary advice, medicines or supplements, in online programmes too.
- Sessions. Clauses 3.5 and 3.6 apply during sessions. If a programme stops part-way, you are refunded at least the price of the sessions not delivered.
6. Adoption#
Effective when this service launches.
- Never a sale. Adoption rehomes a pet; fees only recover costs and are never a price for the animal. No breeding stock, litters, "reservation fees", or puppies or kittens under 8 weeks or unweaned, and everyone listing a pet confirms "I am not breeding or selling this animal".
- Who may list. Verified shelters and rescues registered with the BAI as animal shelters (DA Administrative Circular No. 05, s. 2015) and verified individuals rehoming their own pet may list (each a "lister").
- Fees. A shelter's fee covers its care costs within the in-app limit. An individual may ask only an itemised rehoming fee for actual costs (such as vaccination, deworming, spay or neuter and microchipping) of up to ₱5,000.
- Choosing an adopter. The lister chooses from truthful applications and any meet-and-greet or home check the listing requires, uses your answers only for this adoption and never refuses anyone on a ground the Community Guidelines protect.
- Paying the fee. An approved adopter pays any fee in the app within 72 hours. Payment Protection holds it until the lister records the hand-over, and it is refunded if the adoption does not go ahead.
- Adoption Agreement. At hand-over you both accept the in-app Adoption Agreement, recording your legal names, the pet's identity and microchip, ownership passing on hand-over, the fee (or none), vaccination and neuter status, the documents handed over and only conditions shown on the listing, such as a neuter-by date or a return or first-refusal right. It is the written agreement the Civil Code requires for a donated pet worth over ₱5,000 (Art. 748). Swipaw is not a party.
- Health and registration. Shelters adopt out animals vaccinated and neutered unless a vet advises waiting, when the agreement sets a neuter-by date; individuals disclose the pet's status. The lister hands over the vaccination card, registration papers and microchip details; the adopter undertakes to register a dog with the city or municipal veterinary office within 30 days and keep its vaccinations current (Anti-Rabies Act).
- No resale, no abandonment. Adopters never resell or abandon the pet; abandonment is punishable under the Animal Welfare Act (sec. 7). If it does not work out, contact the lister and follow any return or first-refusal condition in your agreement; there is no right to return a pet for a refund, but your legal remedies for a misdescribed pet remain.
7. Foundations and donations#
Effective when this service launches.
- Permitted organisations only. Only non-stock, non-profit organisations registered with the Securities and Exchange Commission (Revised Corporation Code, RA 11232), holding a current Department of Social Welfare and Development (DSWD) solicitation permit (Solicitation Permit Law, PD 1564) and verified by us receive donations; those housing animals also need BAI registration. Their pages and our acknowledgments show the DSWD permit number and validity, and donations pause if a permit or registration lapses.
- Our role. Swipaw is the organisation's collecting agent, not the recipient: Xendit collects your donation into an account kept for the organisation, and we have it paid out weekly to an account in the organisation's registered name. The organisation answers for how donations are used.
- Amount, fee and purpose. The minimum donation is ₱20. Any Swipaw fee (none by default) and the amount the organisation receives show before you pay. Each appeal states what donations are for, and the organisation uses them only for that and keeps records; we verify documents but do not audit spending.
- Refunds. Donations are final, except payments made by mistake (such as duplicates or a wrong amount) or without your authority, donations to an organisation that lacked a valid permit, and refunds the law requires; write to [email protected]. If an organisation is suspended, loses its permit or fails re-verification for 30 days, donations not yet paid out are refunded and monthly donations to it end.
- Monthly donations. They are charged monthly until you cancel; pause, resume or cancel any time in the app. Cancelling stops future charges but refunds none already made, and repeated failed charges cancel the plan.
- Anonymity. "Anonymous" hides your name only from the donor wall and other members. The organisation receives your verified legal name for its legal records when one donation reaches ₱50,000, your calendar-year total to it reaches ₱500,000, or a regulator lawfully asks. You may also share your name, address and TIN so it can issue you a certificate.
- Receipts and tax. Our donation acknowledgment confirms your payment; it is not an official receipt or a Certificate of Donation (BIR Form 2322), which only the organisation issues. Any donor's tax is yours, and only gifts to accredited donee institutions may be deductible.
8. Events#
Effective when this service launches.
- Organisers. The member or organisation publishing an event (the "organiser") contracts with attendees and answers for the event's details, safety and conduct. Swipaw lists the event, runs tickets and reminders and handles complaints; it is the organiser only if the event page says so.
- Organiser promises. By publishing, the organiser confirms that the venue holds a current business permit and Fire Safety Inspection Certificate and attendance stays within its occupant load (Fire Code, RA 9514); that any Mayor's or barangay permit is obtained and amusement tax handled (Local Government Code, RA 7160); that dogs are leashed (1.5 metres or less) or carried, animals vaccinated and sick or aggressive ones left home; and that a first-aid and bite procedure is ready. Vaccination drives need a PRC-licensed vet; adoption fairs follow section 6.
- Fund-raisers and prizes. A fund-raiser names a section 7 organisation as beneficiary, which receives its ticket money. Raffles, contests and prize games run only under a Department of Trade and Industry (DTI) sales-promotion permit whose number appears in the mechanics and on every entry stub (Consumer Act, Arts. 116–121); an unpermitted lottery is illegal (PD 1602).
- Tickets. Free RSVPs confirm at once; a paid ticket, for you and any guests shown, confirms when paid. Ticket money stays under Payment Protection until the event ends, then goes to the organiser (or a fund-raiser's beneficiary) less our commission (10% by default). Tickets cannot be resold, and only confirmed attendees see the exact venue.
- Refunds. If the organiser cancels, or we cancel or remove the event (including when a government order or typhoon signal stops it), every paid ticket is refunded in full. Cancel at least 24 hours before the start for a full refund; later cancellations and no-shows are not refunded. If an event is materially changed, unsafe or not held as described, tell us through support; your legal remedies apply.
- At the event. Follow the organiser's and venue's rules; each owner answers for their own pet (Civil Code, Art. 2183), and organisers use attendee details only to run the event.
9. Lost and found — tulungan tayo#
Effective when this service launches.
- Truthful posts. Report only a real lost or found cat or dog; a lost report must be about your own pet or one in your care. Never use the board to sell, rehome or advertise, and report wildlife to the Department of Environment and Natural Resources (Wildlife Act, RA 9147), not here.
- Pets, not people. Post photos of the pet only, without faces, plate numbers, names or accusations, and report suspected theft to the police or barangay. Others see your last-seen point only roughly unless you choose otherwise, and never your street address.
- If you find a pet. Keep it safe, fed and sheltered; within 5 days report it to the barangay, the city or municipal veterinary office, the police or a registered shelter, and keep looking for the owner (Animal Welfare Act rules); an in-app alert does not replace that report. For 20 days do not sell, give away, rehome or keep it as yours, as the owner may reclaim it (Civil Code, Art. 716).
- Rewards. A reward is a private promise between owner and finder, paid in person only once the pet is safely back. Swipaw never holds, collects or guarantees rewards.
- Scams. Never pay a "transfer", "delivery" or "verification" fee or share a one-time code to get a pet back; meet in a public place, a vet clinic or the barangay hall; and report anyone who asks for money first (Cybercrime Prevention Act, RA 10175; Anti-Financial Account Scamming Act, RA 12010).
- Sightings and other people's data. Sightings go to the reporter, and their notes, photos and city may be shown to others. A guest helper's first name and mobile number go only to the reporter, for recovering the pet, stay encrypted and are deleted 30 days after the report closes. Anyone shown in a photo may ask us to remove it at [email protected].
10. Pet-friendly places#
Effective when this service launches.
- Check first. Places and their pet policies come from venues and members. We do not represent that a pet policy is lawful, and the Code on Sanitation (PD 856) keeps animals out of food-service areas, so check with the venue before you go.
- Swipaw-verified. The badge means a Swipaw team member visited, or the venue's owner confirmed the pet policy, at that time. It is not a permit, inspection or endorsement.
- Submissions. Submit public venues only, never homes, and business contacts only. We review places from new submitters, and every suggested edit, before they go live.
- Reviews and check-ins. Review or check in only where you have been, under our Review Policy; venues may correct facts by suggesting an edit or writing to [email protected].
11. Memorials and community#
Effective when each of these services launches.
- Memorial Wall. Create a tribute only for a pet that was yours or in your care, or with its family's blessing. Keep comments kind, with no selling, fund-raising, advertising or blame. Candles and paws earn no Paw Points, and you may unlist or delete a tribute at any time.
- Community feed. Post your own pets, or others' with permission, and choose who sees each post; a deleted post disappears at once and its photos are erased within 30 days. Weekly challenges follow their stated mechanics; any involving chance runs only under a DTI permit named in them.
12. Pet Shop (phase 2)#
Effective when this service launches.
- We are the seller. In the Pet Shop you buy from Parada Technologies Inc. as seller of record, which issues your invoice and owes you a seller's duties under the Consumer Act and the Internet Transactions Act.
- Price and delivery. Prices are in pesos and include any VAT. Shipping fees and the estimated delivery window show before you pay, and we deliver only within the Philippines. If we miss the window, we tell you, and you may cancel for a full refund.
- Cancelling. Cancel in the app before we start processing your order for an automatic full refund.
- Returns. Within 7 days of delivery, report a defective, damaged, expired or wrong item for a replacement or full refund, your choice, with return shipping on us. Opened food, treats and hygiene items are returnable only if defective, expired or wrong. We never apply "no return, no exchange" (DTI Department Administrative Order No. 2, s. 1993), and your legal warranties remain.
- What we sell. No live animals. Pet food and treats only if registered with the BAI where required (Livestock and Poultry Feeds Law, RA 1556), and veterinary medicines or products with therapeutic claims only if registered with the Food and Drug Administration or the BAI as the law requires (RA 3720, as amended by RA 9711).
13. Swipaw Plus, boosts and promotions#
Effective when Swipaw Plus or a paid perk launches.
- Store billing. In the apps, Swipaw Plus is sold only through the App Store or Google Play, which show the price, billing period, renewal terms and any trial first. It renews until you cancel in your store account, refunds follow the store's rules, "Restore purchases" brings it back on a new device, and the subscription screen links the Terms, these terms and the Privacy Notice.
- Perks. Super Paws, boosts, undos and vouchers have no cash value, cannot be transferred and last only as long as shown; any sold for money in the apps use store billing.
- Referrals. The referral page shows the rewards, who qualifies (a friend who signs up with your code and verifies an e-mail or mobile number) and the daily limits. Rewards are Paw Points, never cash, and are removed for self-referrals or fake accounts.
