Welcome to Swipaw stud services 🐾 Breeding is a big step for two families and two pets, so these rules keep both animals safe and every promise clear.
In short: Only healthy, intact, vaccinated cats and dogs of breeding age are bred, after fresh health checks. Cash stud fees have Payment Protection until the mating is done and confirmed. Pregnancy is never guaranteed (walang garantiya), though some listings include a free repeat. Pick-of-litter deals are private promises, written in the app. Each owner answers for their own animal; fake papers mean a ban.
1. About these Stud Terms#
- These Stud Service Terms ("Stud Terms") govern stud listings, requests and bookings on Swipaw between the owner offering a male dog or cat (the "stud owner" and "stud") and the owner booking it for a female (the "requester" and "female"). Swipaw is operated by Parada Technologies Inc. ("we"); we are not a breeder, broker, pedigree registry or vet, and guarantee no pregnancy, litter or animal.
- They add to the Terms of Service, Payments & Refunds Policy, Verification Policy, Community Guidelines, Privacy Notice and, for stud owners, the Provider Agreement, and prevail on stud matters. Summaries are aids; the numbered clauses govern.
- Stud owners accept these Stud Terms electronically before a first stud listing, requesters before a first stud request, binding under the Electronic Commerce Act of 2000 (RA 8792); we record the version, time and platform. New versions never change confirmed bookings.
2. Who may offer or book a stud#
- Stud owners need stud verification (ID, selfie, address and each stud's vaccination cards) and list only their own male, intact, Vaccination Verified stud of its profile breed, one listing per stud. Every stud listing, even pick-of-litter only, needs the Provider Agreement and a verified BIR tax profile (BIR Revenue Regulations No. 16-2023), and cash fees need its payment set-up.
- Requesters need a verified e-mail and mobile number, basic verification before paying when the app asks (the default), and their own intact female of the stud's species.
- Breeding kennels and catteries (a "stud farm" in everyday speech) need a Bureau of Animal Industry (BAI) Certificate of Registration under the Animal Welfare Act (RA 8485, as amended by RA 10631). At stud verification you add yours or confirm you keep fewer than 20 dogs or cats aged six months or older (the line in BAI Administrative Order No. 14, s. 2004). If BAI or your city still requires registration, register and update us.
3. Breeding age, health and welfare#
- Eligibility. Both animals must be intact, healthy, physically and temperamentally sound, free of known serious inherited disease and not advised against breeding by a vet. On the mating day females must be 8 months to 10 years old and studs 8 months to 12 years (our policy, adapted from the Philippine Canine Club's litter rules, cats included), checked against honest profile birthdates.
- Frequency (our policy): we recommend no first mating before a female's second heat. No female may be booked within 12 months of her last litter, as the requester confirms in the request. Studs get the rest their vet advises.
- Vaccinations. No stud without verified vaccinations: we check its anti-rabies and core vaccine cards at stud verification, and a stud whose vaccination lapses may not mate until verified again. Before a request, the female's profile must show complete core vaccines and anti-rabies within 12 months.
- Health checks and disclosure. Within 30 days before the mating day, each animal needs a vet check finding it fit to breed, and each dog a negative Brucella canis test; owners state the dates in the request or listing and show certificates on request. Other vet-advised tests are recommended. Each owner also discloses heat dates, previous litters, medication, illness, aggression and bite history; whoever hides a known problem answers for it.
- Natural mating only. Under the Veterinary Medicine Act of 2004 (RA 9268), only a licensed vet may diagnose, treat, give hormones or sedatives, or certify an animal's health. No artificial insemination or semen sales.
4. Listings, offers and the accepted offer#
- A stud listing truthfully states the breed, the deal (stud fee, pick of the litter or either), the price and what it covers (matings, dates, any stay), place, health tests, the repeat-service period (clause 7.4; zero means none) and who pays transport and pre-mating vet checks (stud owner, requester or both equally).
- Where offers are allowed, a requester may offer down to the stud owner's floor or 50% of the price, whichever is higher; the stud owner accepts, rejects or counters. Unanswered requests expire after 72 hours; after a rejection, wait 24 hours to ask again. Chat opens only on a confirmed booking, never after a rejection.
- The accepted offer fixes these terms for the booking (on an "either" listing, which deal applies); side deals are not part of it.
5. Stud fee, pick of the litter and Payment Protection#
- Stud fee. The requester pays through Swipaw's checkout within 24 hours of acceptance, or the booking lapses. The total shown includes taxes, with no fee added.
- Payment Protection. Xendit Philippines, Inc., an operator of payment systems registered with the Bangko Sentral ng Pilipinas, collects the payment into an account kept for the stud owner and holds it until release under section 7 ("Payment Protection"). We only instruct release or refund; we never hold the money. At release, our commission (by default 10%, shown before you list) and any tax we must withhold are split off; the rest is the stud owner's payout.
- Pick of the litter pays the stud owner with a puppy or kitten not yet born. The Civil Code of the Philippines (RA 386, Article 1347) allows future things as the object of a contract, but the promise binds only if a litter is born with a healthy animal of the agreed pick. We do not broker it, hold or value any animal, or decide who owns one.
- Pick-of-Litter Addendum. Any deal with a pick needs a Pick-of-Litter Addendum, generated in the app from the accepted offer and accepted by both owners before any mating. It sets: (a) the pick and who chooses; (b) the litter timeline (by default, the pregnancy check and birth are each reported within 7 days, with photos) and the pick date; (c) hand-over at 8 weeks or later, weaned, vet-vaccinated for its age and vet-certified, and who pays those checks, registry papers and transport; (d) the outcome with no pregnancy, no live litter or too few healthy animals for the pick (by default no animal is owed and clause 7.4 applies), or if the chosen animal dies or is unfit to leave (by default the chooser picks again); and (e) any cash portion paid at booking and whether it is returned without a litter (by default not: it paid for the matings).
- Payment Protection covers only cash paid through checkout, until release; after that the Addendum's promises are owed directly between the owners, and breaking them breaches these Stud Terms. No litter may be advertised or sold on Swipaw, and no "reservation fee" asked for any animal.
6. Mating day#
- Place and supervision. Sessions happen at the booked place (either owner's or an agreed venue), which must be clean, secure, shaded, escape-proof and private. Both owners, or an adult each names in the booking chat, stay throughout, and the stud owner directs. Introduce the animals calmly on leash, with water and shade, and separate them at any sign of aggression or distress. Never force a mating, use painful restraint, pull a tied pair apart or leave them alone. Either owner may stop anytime; no session runs past the booked slot.
- Stays. A host keeping the other owner's animal for an agreed stay uses the diligence of a good father of a family, keeps it from other males, returns it on time and reports any injury, illness or escape to its owner at once and to us through the booking within 2 hours.
- Transport. Under the Animal Welfare Act, animals travel in a ventilated carrier, crate or harness, with water and their anti-rabies certificate, never in a trunk or loose on an open truck bed. Trips out of your province or region also need a BAI shipping permit and a vet health certificate.
- Injuries and vet costs. Under Article 2183 of the Civil Code, whoever possesses or uses an animal answers for the damage it causes, unless it comes from force majeure or the victim's own fault. So each owner answers, including for reasonable vet costs, for what their animal does during the meeting and the tie, and an owner whose fault caused the harm (hiding illness or aggression, forcing a mating, careless handling) pays. Treat first, report it in the booking, then settle by dispute or directly.
- Bites. If a dog bites a person, its owner reports it within 24 hours to the barangay or city veterinary office and through the booking, keeps the dog under a vet's observation for 14 days and pays the victim's medical costs (Anti-Rabies Act of 2007, RA 9482).
7. Completion, and if there is no pregnancy#
- The service is complete when the accepted offer's matings are performed as booked: for dogs, a tie or a witnessed mating; for cats, the agreed witnessed matings. The stud owner then marks the booking complete with a note and, where possible, photos of both animals.
- The requester then has 48 hours to confirm or dispute; after that the booking confirms automatically and the payment is released.
- Pregnancy is not guaranteed: the fee pays for the matings, not for a litter.
- Repeat service. If the accepted offer has a repeat-service period and a licensed vet finds in writing that the female did not conceive, the requester gets one free repeat service with the same stud at a later heat within that period. Send the finding within 75 days of the last mating, via the booking or support; we set the repeat up as a fee-free booking, and section 3 applies again. If the stud owner cannot give it for reasons on their side, they owe back half the stud fee or cash portion, which we may refund from their unpaid earnings.
- Your legal rights stay. Nothing here limits a requester's rights under the Consumer Act of the Philippines (RA 7394) if the service was not delivered or was defective (no mating, a different stud, unsafe conditions, false health claims): dispute before release for re-performance, a refund or a price reduction.
8. Cancellations, heat timing and refunds#
- Windows. Unless the listing showed another policy before you paid, the stud services row below governs a requester's cancellation, counted back from the booked start. The pay screen shows each cut-off as a date and time, and the stud owner keeps what is not refunded, less our commission.
| Service | Free cancellation | Partial refund | Late cancellation |
|---|---|---|---|
| Stud services | Up to 48 h before the start: 100% back | 48 h to 12 h before: 50% back | Less than 12 h before: 0% back |
| Paid playdates | Up to 24 h before the start: 100% back | 24 h to 6 h before: 50% back | Less than 6 h before: 0% back |
| Pet hotel & boarding | Up to 48 h before the start: 100% back | 48 h to 24 h before: 50% back | Less than 24 h before: 0% back |
| Grooming | Up to 24 h before the start: 100% back | 24 h to 6 h before: 50% back | Less than 6 h before: 0% back |
| Vet visits | Up to 12 h before the start: 100% back | 12 h to 3 h before: 50% back | Less than 3 h before: 0% back |
| Sitting & walking | Up to 24 h before the start: 100% back | 24 h to 6 h before: 50% back | Less than 6 h before: 0% back |
- These windows cover a change of mind and reflect the stud owner's loss in holding the stud for a short fertile window; they never limit clause 7.5.
- Heat timing. Book once the heat has started or a vet has timed it, and warn the stud owner if timing shifts. If they agree in the booking chat to another day, our team can cancel with a full refund and no strike so you can rebook.
- On the day. The stud owner may refuse a female who arrives sick, injured, underweight, distressed or with mismatched vaccination records, and must stop if she will not stand or mating would be unsafe (a "welfare stop"). It is recorded with a note, refunded in full and not a strike. If the female never arrives, the stud owner may report a no-show from 60 minutes after the start; it counts as a late cancellation.
- Stud owner cancellations refund in full and count as strikes under the Provider Agreement. Cancellations covered by our force-majeure notice for a typhoon, flood, earthquake or government order refund in full with no strike.
9. Disputes and evidence#
- Either owner may open a dispute in the app from the booked start until release, say over a no-show, no mating or an injured animal; it freezes the payment. Without cash involved, contact support from the booking or at [email protected].
- Evidence helps: session photos or video, certificates and test results, vet records (including the pregnancy check), vaccination cards, receipts and the booking chat, which our team reads only for the dispute, logging each access. Mating images go only into a dispute, never onto public parts of Swipaw.
- Our team aims to decide within 72 hours: refund, release or split. If you disagree, or your complaint is unresolved after 7 calendar days, the routes on our Complaints page open, including the Department of Trade and Industry and the courts (Internet Transactions Act of 2023, RA 11967).
10. Pedigree papers and honesty#
- Pedigree papers stay private. Others see the registry name and, once checked, the Pedigree Verified badge, meaning our reviewer saw papers matching the pet's profile at that time. We do not check papers with the Philippine Canine Club or any registry, or guarantee lineage.
- Fake or borrowed papers, a substituted animal, altered tests or vaccination cards, and lies about age, health or litters are deceptive acts (Consumer Act, Article 50). We may decide held payments for the other owner, ban the account permanently and report it to the authorities.
11. Never allowed#
- On or through Swipaw you may not: (a) breed an animal that fails section 3, such as one underage or unvaccinated; (b) show puppy-mill signs such as many breeding females, back-to-back litters, poor conditions, or puppies or kittens offered before 8 weeks or for sale; (c) offer or seek wildlife or exotic animals (Wildlife Resources Conservation and Protection Act, RA 9147), or breed animals for fighting; (d) give hormones or sedatives without a vet; (e) force a mating; (f) make false pedigree, health or breeding claims; or (g) pay outside the app for a stud booking, or arrange matings outside stud bookings.
- Breaches lead to listing removal, suspension or a permanent ban; we report suspected cruelty or illegal animal trade to the BAI or police.
12. Personal data#
- Once a booking is confirmed, each owner sees the other's verified legal name and the session address. Under the Data Privacy Act of 2012 (RA 10173), each owner is separately responsible for that data: use it only for this booking and any Addendum, never for marketing; keep it secure; delete it when settled; report any leak to [email protected] within 24 hours.
- The booking chat becomes read-only 7 days after completion or cancellation.
13. Questions? Kausapin mo kami#
- Questions about a stud booking, an animal's welfare or these Stud Terms? Write to [email protected] or open a ticket in the app.
